Formdesk enables its customers to design and publish forms. Formdesk processes and stores the data entered in the forms on behalf of its customers. You may therefore come into contact with Formdesk as a (potential) customer, as a respondent when you fill in a form from one of our customers or as a visitor to our website. In this privacy statement you can read how we handle your privacy.

What information do we collect and for what purpose?

From our customers

Before you design your first form with Formdesk, you must register. The personal information requested from you is limited to the minimum and necessary for the maintenance of your account, the proper functioning of Formdesk and to keep you informed of developments within Formdesk. If you choose one of our subscriptions, we also request information on the basis of which we can invoice you.

You determine which information you collect using the forms and this is your responsibility. We only use the information to execute the orders you give within your account or that you have set with your forms.

We keep certain ‘metadata’ in a log during your use of Formdesk: the pages you visit, your IP address and the browser you use. This data is used to improve our services to you, to solve any problems that may occur and to detect abuse or fraud.

From respondents

We collect the data that you fill in on a form on behalf of the relevant customer. This customer is responsible for the design of the form and manages your data. The customer will have a privacy policy of their own. If you have any questions about the form or how the designer handles your data, it is best to contact the customer directly.

We process your data exclusively on behalf of our customer and will never use your data for our own purposes or make it available to third parties without the permission of our customer.

In addition to the data that you enter on a form, we keep certain ‘meta-data’ in a log: the form that you fill in, the page of origin, your IP address and the browser that you use. This data is used to support our customers, to solve any problems that may occur and to detect abuse or fraud.

How long do we store your data?

From our customers

We store your data until your subscription ends or until your trial period expires. One month after your subscription ends, your account will be deleted so that you still have the opportunity to secure the data.

You manage the data of your respondents yourself. Formdesk offers you the option to set retention periods so that data is automatically deleted.

Do we share data with third parties?

In general

In order to be able to offer you Formdesk, we use the services of other parties. When third parties process your personal data on our behalf and according to our strict instructions, those third parties act as so-called sub-processors. Formdesk concludes a processing agreement with sub-processors to ensure the same level of security and confidentiality of your data.

From our customers

Formdesk offers options to share data with other parties after completing a form. For example, you can think of sharing data with a payment provider to make a payment or sharing data with an SMS provider to send an SMS. These parties have their own privacy policy and we recommend that you review the privacy policy of each party before releasing personally identifiable information.

From respondents

We process your data exclusively on behalf of our customer and sending your data is one of the options that Formdesk offers. For example, if you have to pay for something you have purchased or registered for, our customer can set the form to start a payment with a payment provider of the customer’s choice after completing the form. We only offer the possibility of a connection and have no relationship with the third party.

Security

The protection of your data is of great importance to us. We have therefore taken various technical and organizational security measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. For example, Formdesk uses network segmentation, firewalls, anti-DDoS systems, anti-malware systems, strong authentication, encrypted transfer of information, monitoring and alarming and encryption (data-at-rest and data-in-transit).

Organizational measures also include ‘least-privilege’ principles, screening of employees and procedures for managing adjustments, incidents and vulnerabilities.

A penetration test is performed by an independent third party at least once a year. In addition, we have a ‘Security Exploit Bounty Program’ in which security specialists are invited to test Formdesk and report possible vulnerabilities to us.

What rights do you have?

European privacy legislation, the GDPR, gives every individual rights with regard to their personally identifiable information that an organization has collected:

If you wish to exercise your right as a respondent, you can contact our client, the designer of the form where you left your data. We process your data on their behalf and on their instructions. The responsibility for the use of your data lies with them. If you, as a customer, wish support in carrying out a respondent’s request, you can contact our service desk.
